Terms and Conditions of Celeste-Atalier

Section 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise the right of withdrawal.
Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance agreement with the entrepreneur.
Day: calendar day.
Continuing transaction: a distance agreement relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
Durable data carrier: any medium that enables the consumer or entrepreneur to store information personally addressed to them in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the consumer’s option to withdraw from the distance agreement within the cooling-off period.
Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance.
Distance agreement: an agreement concluded between the entrepreneur and the consumer within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement.
Technique for distance communication: any means that can be used to conclude an agreement without the consumer and the entrepreneur being together in the same place at the same time.
General Terms and Conditions: these present Terms and Conditions of the entrepreneur.

Section 3 – Applicability

These general terms and conditions apply to every offer from the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded, the text of these terms and conditions shall be made available to the consumer. If this is not reasonably possible, the entrepreneur shall indicate before the agreement is concluded how the terms and conditions can be accessed and that they will be sent to the consumer free of charge upon request.

If the distance agreement is concluded electronically, the text of these terms and conditions may be made available to the consumer electronically in such a way that they can easily be stored on a durable data carrier.

If specific product or service conditions also apply, the consumer may always rely on the provision that is most favorable to them in the event of conflicting terms.

If any provision of these terms and conditions is found to be invalid or annulled, the remaining provisions will remain in effect. The invalid clause will be replaced by a valid provision that most closely matches the intent of the original.

Situations not covered by these terms shall be interpreted “in the spirit” of these terms.


Section 4 – The Offer

If an offer is subject to a limited period of validity or specific conditions, this shall be explicitly stated.

The offer is non-binding; the entrepreneur may modify or withdraw it.

The offer includes a complete and accurate description of the products and/or services offered. Images are intended to be a truthful representation, though minor variations in color or appearance may occur.

Each offer clearly states the rights and obligations associated with acceptance, including:

  • The price (excluding import duties and customs VAT, which are the responsibility of the customer).

  • Any shipping costs.

  • The method by which the agreement will be concluded.

  • Whether the right of withdrawal applies.

  • Methods of payment, delivery, and execution.

  • The validity of the offer and price guarantee.

  • Whether the contract will be archived and accessible.

  • Any applicable languages, codes of conduct, or specific product options (sizes, colors, materials).


Section 5 – The Agreement

The agreement is established when the consumer accepts the offer and meets the stated conditions.

If acceptance occurs electronically, the entrepreneur shall promptly confirm receipt. Until this confirmation is received, the consumer may cancel the agreement.

The entrepreneur shall implement technical and organizational measures to secure data transfers and ensure a safe online environment.

The entrepreneur reserves the right to verify, within legal limits, whether the consumer can meet payment obligations. If there are legitimate grounds, the entrepreneur may refuse an order or attach special conditions to it.

Upon delivery, the entrepreneur shall provide the consumer with written or electronic information including:

  • Contact details for submitting complaints.

  • Conditions and methods for exercising the right of withdrawal.

  • Warranty and after-sales service information.

  • The terms set out in Section 4, unless already provided.


Section 6 – Right of Withdrawal

When purchasing products, the consumer has the right to withdraw from the agreement within 30 days of receiving the goods, without giving reasons.

During this period, the consumer shall handle the product and packaging with care. The product may be inspected only to the extent necessary to determine whether it will be kept.

If the consumer wishes to exercise the right of withdrawal, they must notify the entrepreneur in writing (via email) within 30 days of receipt. After notification, the product must be returned within 30 days. Proof of timely shipment (such as a postal receipt) must be provided.

If the consumer fails to notify or return the product within the required period, the purchase is considered final.


Section 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, return shipping costs are entirely at their own expense. This includes any international return costs (for example, returning to our supplier in China).

Once the returned product has been received or sufficient proof of return is provided, the entrepreneur will refund the purchase amount within 30 days.


Section 8 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude the consumer’s right of withdrawal for products or services as described below, provided this is clearly stated prior to purchase:

  • Products made to the consumer’s specifications or clearly personalized.

  • Products that cannot be returned due to their nature.

  • Perishable goods.

  • Products subject to market fluctuations beyond the entrepreneur’s control.

  • Sealed audio, video, or software items that have been opened.

  • Hygiene products with broken seals.

  • Services such as accommodation, transport, catering, leisure activities, or lottery participation tied to a specific date.


Section 9 – Pricing

Prices of products and services will not be increased during the validity period stated in the offer, except for VAT or legal changes.

All prices are subject to typographical errors. The entrepreneur is not obliged to honor incorrectly displayed prices.

Deliveries are made from outside the EU. Any import duties or VAT will be collected by the postal or courier service at delivery. No VAT will be charged by the entrepreneur.


Section 10 – Conformity and Warranty

The entrepreneur guarantees that the products comply with the agreement, product specifications, and reasonable expectations of reliability and usability.

Defective or incorrectly delivered items must be reported within 30 days of delivery. Products must be returned in their original packaging and condition.

The warranty period equals the manufacturer’s warranty period. This warranty does not apply if:

  • The consumer or third party repaired or modified the product.

  • The product was improperly used or treated carelessly.

  • Defects resulted from government regulations regarding materials or quality.


Section 11 – Delivery and Execution

The entrepreneur will exercise the greatest possible care in processing and shipping orders.

Delivery is made to the address provided by the consumer.
Orders are shipped as quickly as possible, typically within 30 days unless otherwise agreed.
If a delay occurs, the consumer will be notified within 30 days and may cancel the order without cost.

If an order is canceled, the entrepreneur will refund all payments within 30 days.

The entrepreneur bears the risk of loss or damage until delivery to the consumer.


Section 12 – Duration Transactions: Termination and Renewal

The consumer may terminate an indefinite-term contract at any time with a notice period of no more than one month.
Fixed-term contracts may be terminated at the end of the term with the same notice period.

Contracts may not be automatically renewed for fixed terms longer than originally agreed.
Trial subscriptions automatically end after the trial period.

If a contract exceeds one year, the consumer may cancel after one year with one month’s notice.


Section 13 – Payment

Unless otherwise agreed, payments must be made within 7 working days after the start of the cooling-off period.

The consumer must promptly report any inaccuracies in provided payment information.

In case of non-payment, the entrepreneur is entitled to charge reasonable collection costs, as permitted by law.


Section 14 – Complaints Procedure

Complaints regarding the execution of the agreement must be submitted in writing within 7 days after the consumer discovers the issue.

Complaints will be answered within 30 days of receipt. If more time is needed, the consumer will be informed accordingly.

A justified complaint will result in replacement or repair of the product at no cost.


Section 15 – Disputes

All agreements between the entrepreneur and the consumer to which these terms apply are governed exclusively by Dutch law, even if the consumer resides abroad.
